The Terms and Conditions of Use set out below are available in French and English. Roche Diabetes Care France may change the Terms and Conditions of Use at any time without prior notice. User can access the Terms and Conditions of Use at any time, by visiting the "About" section of the Gluci-Chek App.
The use of Gluci-Chek App implies acceptance by User of all of these provisions.
The Gluci-Chek App is to be used to provide information to the general public and, specifically, for patients with diabetes under insulin-treatment. It comprises:

The functionalities made available to the User have been designed to meet the above-mentioned objectives. They enable the User to record information and use the Gluci-Chek App as a carbohydrates self-monitoring logbook.
The information the Gluci-Chek App may contain or transmit is not intended in any way to replace the patient / healthcare professional relationship or replace a medical consultation. The information found in the Gluci-Chek App does not constitute a consultation or a treatment recommendation and should not be considered as such.
With the Gluci-Chek App, Roche Diabetes Care France does not claim it can provide customized personal medical advice or recommendation, or draw conclusions from the results obtained from the data entered by the User.
The Gluci-Chek App must be used in accordance with its intended purpose and with these Terms and Conditions of Use.
The Gluci-Chek App is used under the sole User’s responsibility, control and management. The User is aware the data recorded in their equipment/mobile phone, via the Gluci-Chek App, may be accessed by anyone having access to the aforementioned devices. The User commits to implement all adequate measures to protect access to these devices.
Roche Diabetes Care France has no control over how the Gluci-Chek App is used by the User or a third party or however the information provided is interpreted.
Roche Diabetes Care France is not responsible for the topicality, quality, completeness and accuracy of data entered by the User. In no event is Roche Diabetes Care France able to appreciate the User's state of health or situation. The User is solely responsible for any decision made or action implemented based on the information entered in the Gluci-Chek App and for the results. The Gluci-Chek App does not conduct any control of the adequacy or consistency of the data entered by the User.
The User of the Gluci-Chek App agrees to use it in compliance with the applicable legislation in France and applicable regulations in the relevant country if the User is not a native of France, including legislation on the protection of intellectual and/or industrial property rights. It is the same with regard to (but not limited to) the rules of public order, respect for the privacy of individuals or in case of computer fraud.
The Gluci-Chek App User is aware of the constraints and limitations of mobile Internet and telecommunications networks, and therefore commits to:
The User acknowledges that access to the hypertext links leading to the Roche Diabetes Care France internet sites offered in the Gluci-Chek App (hereafter the “Websites”) is conditioned to the conditions of coverage, saturation and availability of the telephone network they have selected.
Besides, the User acknowledges the good working of the Gluci-Chek App is conditioned to their device/mobile phone operating system.
More generally, Roche Diabetes Care France will in no way be held responsible for all direct and indirect damage whatsoever arising from use of the Gluci-Chek App in any way and under any circumstances whatsoever.
The industrial property or copyright rules are the current French legislation applicable to the Gluci-Chek App.
All brands listed in the Gluci-Chek App are owned directly or licensed by a Roche Group company.
All components in the Gluci-Chek App (text, data, databases, graphic designs, names, brands, animation, photos, layouts, logos, etc.) are covered by copyright and intellectual property rights. Roche Diabetes Care France grants the User a non-exclusive, non-transferable, personal, limited right to access, use, view and copy the elements of the Gluci-Chek App. This right is granted for exclusively personal and non-commercial use. Any reproduction, transmission, distribution or other use of information or content of the Gluci-Chek App beyond the scope of the above-described purpose is strictly prohibited. Any request to use or reproduce information from the contents, for any purpose other than those stipulated in these Terms and Conditions of Use, must be submitted to Roche Diabetes Care France in order to obtain prior written approval.
The User is informed that the Gluci-Chek App permits recording their own data such as blood glucose tests, insulin doses, and they agree.
The User is aware that Roche Diabetes Care France cannot collect or process any data, in particular personal details regarding the User or any other person whose data are entered in the Gluci-Chek App by the User.
The User acknowledges he is solely responsible for recording, processing and using the information he enters, under their sole control and direction, into the Gluci-Chek App, and that they agree to take any sensible precautions, in particular in terms of secure access to their equipment/mobile device, so that said information cannot be accessed by unauthorized third parties. In no case, shall Roche Diabetes Care France be responsible for access by such third parties to such data entered in the Gluci-Chek App.
As mentioned above, Roche Diabetes Care France informs the User it collects no information about them when using the Gluci-Chek App. However, Roche Diabetes Care France may be required to use Google Analytics, a web analytics service provided by Google, Inc. ("Google"), with a view to continuous improvement of the Gluci-Chek App, without prejudice to the above-mentioned provisions.
Google Analytics uses "scripts", which are text files placed on the equipment/mobile device to help the mobile application analyze how users use them. To this end, anonymous statistical data relating to the User’s navigation in the Gluci-Chek App, equipment/mobile device, as well as its operating system, are collected and transmitted to Roche Diabetes Care France during the User’s visit to his Gluci-Chek App.
The information generated by the cookie about Users’ way of using the Gluci-Chek App are transmitted and stored by Google on its US servers. Google uses this information to assess the way the Gluci-Chek App is used, compile rapports about activities on the Gluci-Chek App for its operators and provide other services related to activities on the Gluci-Chek App. Google may also transfer this information to third parties when required by law or when these third parties process this information on behalf of Google. Nevertheless, the AppCelerator Titanium development platform used for the Gluci-Chek App makes it possible to hide Users’ IP addresses. Therefore, neither Google nor Roche Diabetes Care France are able to identify a User thanks to the data entered by the User.
The User may at any time disable this feature by going to the settings of the Gluci-Chek App, according to the following option:
By continuing to use the Gluci-Chek App without changing this setting, the User agrees to help Roche Diabetes Care France improve the Gluci-Chek App and implicitly authorizes processing by Google of data concerning the User in the manner and within the purpose indicated above.
Roche Diabetes Care France is likely to offer to the User the hypertext links leading to websites belonging to Roche Diabetes Care France. These Websites are governed by their own terms of use, and Roche Diabetes Care France recommends reading them before consulting such sites.
These Websites use cookies.
A cookie is information that is automatically placed on the browser of the equipment/mobile device when the User accesses some particular websites. A cookie uniquely identifies the User's browser in the server.
Roche Diabetes Care France uses data connections to plot its consultation statistics (type of browser, number of visitors, pages visited, etc.) to optimize its websites in terms of pages and browsing, but this information is not passed on to third parties.
When navigating on Roche Diabetes Care France’s Websites, cookies are installed on the browser. They are not intended to know the User’s habits, or set the presentation of Websites according to their click-stream. Roche Diabetes Care France resorts to them to make browsing more enjoyable for the User and to undertake analyses and performance reviews of its Websites. By continuing to browse these Websites, the User accepts the use of cookies.
Most browsers are configured to accept cookies, but it is possible for the User to reset their own, to refuse all cookies or indicate when a cookie is sent. The Gluci-Chek App contains components and information which comply with applicable French legislation and includes food products available on French territory. Roche Diabetes Care France is not responsible with regard to access to information that might not be compatible with the legislation, regulation or usage outside France.

Besides, Roche Diabetes Care France does not warrant that:
Roche Diabetes Care France cannot be held responsible for a malfunction of the Gluci-Chek App and from the resulting consequences.
Roche Diabetes Care France reserves the right to modify the Gluci-Chek App at any time without prior notice, but is not obliged to provide updates.
In general, Roche Diabetes Care France also reserves the right to stop providing the Gluci-Chek App at any time without prior notice and this shall not entitle the beneficiary of the service to any compensation.
These Terms and Conditions of Use of the Gluci-Chek App are subject to French law. In case of dispute, the parties will attempt to find an amicable settlement. Failing this, the dispute shall be submitted to the competent courts.
Should any provision of these Terms and Conditions of Use of Gluci-Chek App prove invalid, illegal or unenforceable for any reason, its nullity, illegality or unenforceability will not affect the validity and enforceability of the remaining provisions.
